Since the IRS doesn&#039;t recognize gay marriage, the only option is to file single or head of household.  This existed long before the gay marriage issue came about - so to categorize it as a &quot;penalty for being gay&quot; is pretty ridiculous.</description>

Yes, in fact if you ever take Economics 101 they will talk about what is called pigovian tax which has been used quite a bit throughout history in various ways. The basic premise is that you tax people to encourage or discourage some sort of behavior as opposed to making it specifically illegal. Typically its not done through income tax, but it has been done this way before. It has been done a lot, especially directly taxing some sort of product -  and yes it has been contested to the supreme court before, its perfectly within the confines of the constitution.</description>
