Are there penalties for filing a false harassment complaint?

A co-worker of mine is in danger of losing his job because another co-worker (female) accused him of harrassment. If he’s guilty, of course he should have to deal with the consequences of his behavior. But if he’s innocent, are there (or should there) be penatlies for his accuser for endangering his livlihood and reputation under false pretenses? Thanks.

    Yes…there are penalties…but on two levels..at least.
    1) Within the company
    2) In civil court. If the charges cannot be substantiated…or better yet for your friend…if they can be disproven…the he stands a chance of bringing her before a court of law for punitive damages and slander.

    Too hard to prove and since OJ all the courts are afraid not to find men guilty. He’s screwed

    Yes. It could constitute the tort of libel and/or slander depending on the circumstances.

    If the false complaint is made to the police there are criminal statutes addressing it as well.
