Bank Levy was placed onto my wife’s and mine joint bank account for a debt under her name.?
We fully understand and know we have to pay this. However, I don’t understand how they can take my entire military retirement pay, I know not even the IRS can’t take the entire retirement pay from a bank as it is against the law, especially since the debt in my wife’s name only, not mine. The bank knows this is my military retirement money, they even identify it as such in our bank statement. I thought MY military retirement pay was protected to some degree. Also, soon I will be receiving SSDI as I am fully disabled, will that be protected, or can they take that too? Again we know we have to pay, however, we are financially troubled, I have been unable to work since 2007, and anyone who knows the social security disability process knows it can take forever, well in my case almost three years. Any information, or advice will be truly appreciated.

You’ve got it wrong.
It’s a joint account.
Either your or your wife can write a check at any time for the entire balance.
The bank levy simply wrote the “check” for your wife. Perfectly legal.
“I know not even the IRS can’t take” not true for the same reason.
Go the bank NOW and get a new account in your name only or this can keep happening.
It’s a joint account. Even “telling the bank” that some of the money there should not be levied is not a viable solution. You need to have your military retired pay deposited in a separate account in your name only. Same thing for your SSDI.
A couple of things.
1) They are not garnishing your retirement pay, they are raiding an account that has your wife’s name on it. They don’t know nor do they care where that money cam from.
2) This didn’t sneak up on you. It takes several months of collection efforts and a court hearing which you obviously lost to be able garnish wages or raid bank accounts, you should have seen this coming.
3) If you want to protect your retirement income you need to put it in an account that does not have your wife’s name on it.
they are raiding your collective assets to cover your collective debt. if you dont want them to take anymore, dont put it there for them to take. you have to remember that they dont know what each dollar in your account is named, they just see dollars/assets. this will continue to happen until the debt is paid off or you make it stop. as one person suggested, you should temporarily get an account in just your name and keep the money you plan on living on in that account. also, court orders usually only happen to income or payroll, i think, which means that you or your wife gave them access to your bank account? pay all collections debts with money order or cashiers check, it keeps them from getting your bank account number, should you write a personal check.
What kind of scumbag debt collector levy’s military retirement and SSDI income??!! Since you have the time, I would get on the phone with the Federal Trade Commission, the state Attorney General, and any other state and federal agency that I could think of to put these people out of business.
I could not help but notice the LV sign on your avatar.. hubby and I just moved from LV in July. So research this company and make sure that all of their state an city licenses are current… if they are not, have them investigated. LV and Nevada are pretty much totally corrupt – especially the courts – so there is no such thing as justice – only state and city revenue. Further, you can’t get anything done in LV without an attorney.. so have a free consult with a bankruptcy attorney and see what he/she says. There are a million of them to chose from in that town!
And, of course, as everyone else suggested.. open a new account and have everything re-routed immediately!
