My debt collector has agreed to settled an offer with me. But?…..?
Ok so I owed a couple thousand dollars to a credit card company, and a debt collector has been contacting me for the past couple years.
They have levied my bank account (starting last month)..
But I settled an offer with them the other day for a lower amount and they accepted.
I asked them that I would like them to send me documentation showing I have settled for the amount, and it has to be sign by them first. Then I will sign it, make a copy of it, and mail it back to them along with the check.
However, they told me “that’s not our procedure.” They want me to confirm that the payment has been mailed, and THEN they will create a settlement contract.
They expect me to give them the check before they send me the settlement contract.
Is this safe?
What if I tell them that I will send the check, but I wont deposit any money into my account, until I see and sign the contract??
Would that be good?
If I say no, they will probably keep on levying my bank account.
What should I do?

do not send any money until you get a written agreement.
I don’t know the law in the US
However… this is my opinion based on a knowledge of debt collection in the UK
First of all. I assume you accept the legality of the debt, and the legality of this agency to collect the debt
so
you have made the error. you owe the money. you have now come to a mutual agreement to _your_ own benefit.
you should seize this offer with both hands
at the moment you seem like you are putting obstacles in the way of clearing your debt.
be reasonable… make sure all your requests are reasonable
at the moment , you are saying I WANT THIS, YOU HAVE TO DO THIS BEFORE I DO THAT.
ask for a statement and a payment agreement….ask for a (responsible) person to agree to be recorded, agreeing to the payment schedule. after all, you only want something to back you up, if things dont go as they promise. be reasonable, open, honest and show a little humility. be nice.
tell them that you want to protect yourself
having worked in a public facing role, I can vouch that if you listen to 20 screaming idiots everyday, then someone being nice and reasonable earn them a lot of kudos points
If they are taking money from your bank account, I assume they have already won a court case. Once that takes place, I don’t know what the rules are for another settlement agreement. The first answer was correct, DO NOT send them money and assume they will honor a verbal agreement to accept it as payment in full.
