₪₪₪ The IRS messed up, and we have the papers to prove it. What can we do? (Info inside)?
1. My boyfriend and his brother got an inheritance from their grandfather in 2001(brother), and 2003(boyfriend). It was tax-exempt, and we have the papers that say so(It was not 401k, it was 100% tax-exempt)
2. My boyfriend’s brother got it resolved in 2008, but they did the same thing to him at first. So we know that it can be resolved so that my boyfriend does not owe any money.
3. Problem is, until then, there is a levy on his paycheck. It takes $900 out a month, and leaves him with not enough money for even HALF of rent.
4. The IRS still has to process it. Meaning, that levy will wrongly be on the paycheck until it’s resolved. (Probably won’t be fixed til end of the month)
5. The IRS never notified him with any letters saying they were trying to collect money. A levy is the last thing they do. He has YET to have a single letter recieved, even after talking to them!
6. My boyfriend’s employer recieved a notice that he’d have a levy. According to the Taxpayers Rights, he must have 21 days notice.
A. If, his employer did not give 21 days notice, could his employer be in trouble?
B. If the IRS didn’t give him a notice, or applied the levy before 21 days of notifying, what can we do?
***I asked this question a few hours ago, but everyone who responded was arguing with me, saying I was wrong, my boyfriend was a liar, and that it’s all his fault. Please, do not respond like that. His family has been through this before. We just don’t know what to do until it gets fixed. We’re under enough stress that we don’t need rude remarks or people trying to prove us wrong, when we got all the paperwork we need.***
