Are you behind on child support or something? Garnishing your wages means that they will take a certain portion from your paycheck (before you get any money, they take their cut). I would assume that levying your bank account would mean they would take money from there as well.
if you owe people money and dont pay, they can sue and take you to court… if they win (and likely they will if you owe the money) it means when payday comes, they TAKE the money from your paycheck….
it means you better not run and hide cause that don’t work. pay your bills.

Can a credit card company garnish your wages?

Answer
A creditor can not garnish your wages without a court order. Actually, the only thing they CAN do is to take you to court, which is a possibility. However, without such action, there is nothing they can do to you outside of calling you and writing you in an attempt to collect on the debt.
Answer
Capitol one had a judgement on my husband and two months later without a court order garnished my checking account for his debt. What can I do? I thought it was illegal to take money out of my account without a court order and the bank let them. Sincerly Debra Murphy
Answer
Wage garnishment laws vary state to state although there are federal guidelines. You need to speak with a lawyer if this is a concern. In general, most states do not allow wage garnishment for credit card debt.
Answer
There are only four states that do not allow wage garnishment for credito debt, they are North and South Carolina, Pennsylvania and Texas. If a creditor has a judgment, then a lawsuit has been filed and the plaintiff/creditor won the suit and received a writ of judgment. Garnishment of wages or levy of bank accounts cannot be done arbitrarily by a creditor, they must follow due process even if it involves arbitration proceedings. Banks cannot release funds to a creditor for repayment of debt w/o a valid court order allowing the action.
Answer
Only after they have gone through the process of taking you to court suing you, winning the suit, and then applying for a garnishment order. All of this takes time and oney. They can sue you in small claims court, depending on the amount you owe and your state. It is always best to try and reach an agreement with the company before it reaches litigation.
Answer

Garnish means that they will take the money FROM your paycheck. They contact your employer and tell them that they have a court order (or if it’s the tax man, that you owe taxes) to have a certain amount “garnished” or withdrawn from your pay. Your employer HAS to do it cause it’s a court order.
So they calculate your paycheck and before your boss writes your check to you they subtract what the “garnished” amount is and you get what’s left. If there’s nothing left then you get nothing and the next pay period they do it again and on and on until the amount is paid in full.
To Levy your bank account means they tell the bank basically the same thing. That they must “give them” all the money in your account and any more money that comes in goes to them too (say, if you have direct deposit for instance) until the amount is paid.
If you can get hold of these people and work out payments you should. If it’s for something like child support you can set it up so that it is taken out of your paycheck automatically each pay day and you get the rest.
Sorry you’re in such a jam. Good luck to you.
