Where can I find Information on Workplace Harassment?

This is occuring in Missouri, and here are a few details.

The boss of one branch of a company decided to go to a different company. As the operations of the branch rely on that person, the other people in that branch decided to go as well. Everyone turned in their resignation, and now the Company is threatening to individually sue anyone who does leave the company. This is a big company, and this threat has frightened a number of employees into questioning whether to leave or not. I know such threats are certainly against the law, as they have no right to stop someone from quitting their job. To better handle this situation, I need to find government websites with information on the laws. Can anyone tell me of a couple good websites to start at?

Do you have those threats in writing? Unless you are a slave, you have the right to work or not work as you choose.

Usually there are copies of it kept in staff lounge, supervisors office, human resource office, and corporate compliance office. Also during the time of your orientation they give you a booklet that you should keep for reference that your human resource department or corporate compliance officer give you whenever you may need it, and also you can use those resources to report anything from company fraud to sexual harrasmment. Many employees may not know about this but those are part of your EEO laws when you use these resources wisely. hope this helps

    According to: http://research.lawyers.com/Missouri/Employment-Law-in-Missouri.html

Missouri law dictates that all employment is “employment at will.” At the link, scroll down to “Employment” and read the section on “At Will” and you’ll find that you have the right to end your employment at any time for any reason. Furthermore, the employer has the right to fire you at any time as long as it is not based on discrimination. Additionally, the employer will need some justification for firing you other than he just felt like it.

Additionally, if you scroll down a little further you’ll find that it is illegal for an employer to terminate you:

    - For refusing to break a law
    - In retaliation for filing a discrimination or safety claim
    - For taking leave under the Family and Medical Leave Act without following its own stated procedure or policy
    - For reasons not contained in the employment contract, if one exists

The only one that would apply in your case might be the last one with the employment contract, so you’ll want to check that out.

You’ll also want to check out the Missouri State Department of Labor and Industrial Relations which would handle this sort of thing at: http://www.dolir.mo.gov/

I would call them at (573) 751-4091 and ask them personally about this situation.

I hope this is helpful. If you get nothing else from this response, just know that his suit is baseless and it is an empty threat. Also know that what he is doing is illegal which you rightfully stated.
